okay, so Im in a very akward situation

I won a game and it seems that the person who made the giveaway actually regifted it so Im not sure what I should do now since if I dont activate, I will get suspended and if I do, Im basically giving CV for somebody who is exploiting the system ><

Report it, don't activate and don't mark it at all. Wait for support to figure it out and answer you.

Don't mark it as received since that would (as you said) reward the exploiter, but don't activate the game yet either, since that runs the risk of getting you suspended. And since you technically did receive it, marking it as not received is being untrue.

Sometimes, things get complicated. This is one of those times.
