Well, I just got a wonderful text from an old co-worker! By wonderful I mean I found out that they did not issue my last paycheck. In fact, they just assumed I would not notice that I had not been paid for the few shifts I had and would be silent. When I asked a friend of mine who still works there to talk to them, they said "It's in the mail". This was a week ago.

Flash forward to today, I get a random text message saying "Hey they neglected to issue your final check, I'm supposed to be picking it up today and I will drop it off later this afternoon. Sorry about this I should have pushed them harder."

Now, in my state the law on the books states:

  • The law requires that all wages be paid on the next regular payday after an
    employee quits. The law does allow an employer to withhold the final paycheck until the
    employee returns any property that belongs to the employer.

  • All wages and compensation earned are due on the next regular payday after the
    employee is terminated. The law does allow an employer to withhold the final paycheck
    until the employee returns any property that belongs to the employer.

Also, although I cannot find the law atm, I am fairly certain that they cannot release your paycheck to someone unless you authorize it. It doesn't bug me that my friend is picking it up, it bugs me that the idiots who don't know how to run a business are following unethical business practices and it makes me wonder how many people have been screwed by them before.

Local place, opened up as a bar with a kitchen but they have no idea how to promote the bar so it became a restaurant with a bar.

Their facebook page is wonderful to read, they reply with total snark and almost insults to people who offer constructive criticism or comments.

When complaining about money, which every one of us in the kitchen did, the Front of House Manager said "We've flipped this kitchen 6 times in a year we can do it a 7th." That was the last straw for me.

Yup, they've kept their two Kitchen Managers and 1 prep cook but everything else has been changed over at least 6 times. In my time there I saw 3 cooks leave my first week, 4 dishwashers, 2 prep cooks and I trained another 8 cooks easily. I was only there for about 4 months.

They had a great first year, now the newness is wearing off and numbers are dropping. Owner panics by firing all of the help none of the management and complains about needing "better people here".

This is what happens when people who own a fast food franchise try to open a true bar and restaurant. Happens far too often where I live, which sucks. Thats a big reason why I'm saving up for a food truck concept I wanna open.

Meh ... I've seen and been through worse. At this point, I'd just be glad I got a last paycheck without a fight and chalk it up as a life lesson. Really, I've had one employer "lose my last timecard", another (cash job doing carpentry work) disputed how much we agreed on for the job and shorted me $700, then claimed I owed him money for tools that were mine to begin with.

They tend to know before they try to scam you that it's more money than it's worth to go after them. I'd just let it go and let Karma deal with them. Sounds like they won't be in business long with their shoddy practices anyway.

It wouldn't cost me a dime to do anything with them, all I'd have to do is file a report with the Department of Labor and Better Business Bureau. I know of at least one other employee that it happened to, he never got his paycheck they just totally screwed him over after firing him.

I'm kinda leaning towards letting karma get them but at the same time, I really want to take a crap in a bag light it on fire and leave it on their doorstep. Metaphorically speaking.

I would have fought the lost time card personally, made it hell for them and recorded my hours down myself to turn into them. That's just me though haha. As far as the carpentry work sounds like you ran into a real jackass who was out to scam you from day one. Just goes to show you that Slipknot was right.

I don't know how the Labor Board is in your state, but it's absolutely awful in Illinois. Everything is dealt with on a priority basis, and it can take months just to get a response, and more often than not they'll do whatever they can to get out of helping you. In the second case, I did get most of my money eventually by having a union rep pay him a visit. And yeah -- the guy was a jackass -- I remember him making an apprentice (carpenter) sit on the median in the middle of a busy highway and pound nails into a board for 8 hours because he screwed something up (I don't even remember now what the kid messed up). He was eventually run out of the state by the union, and now teaches history to high schoolers several states away. ;)

Anyway, the point wasn't that things could be worse -- it was more or less that you're probably going to run into worse situations over the course of your working life. You may have had to wait a bit, but you did eventually get paid, and with your former employers being the pricks they are, it seems like they're going to get what's coming to them sooner or later. Chalk it up as a learning experience -- to remind yourself not to work for scumbags like that again, and learn what not to do when you open your own business. Hopefully you're young enough that this negative experience won't affect you too much and your next job will be much better. :)

I'm a 33 year old trained chef who also holds a cicerone certification for craft beer service. I've never dealt with someone doing this before and I've worked for many independently owned places and locally owned places. Hell I spent my college years working in a one man kitchen in a dive bar in Nordeast (North East Minneapolis) and even that owner was not this unethical....and he did some questionable shit lol.

EDIT - Our state is going through some huge controversy right now with government agencies checking things, the labor board usually handles complaints relatively quick ( ones that deal with money especially ) and I have a feeling that now the odds of it getting ignored are slim to none after all the issues brought up in the last few months here. South Dakota is learning that having Republicans run every aspect of state government is not a good thing. Hell one party controlling everything is always bad no matter the party.

Ah, OK, my apologies then. It was a bit hard to tell from your OP your age and what sort of job you were working in the food service industry. I tend to assume most people on this site are on the younger side (though you're still only a year older than my eldest stepson haha). Probably not a good habit to have, but one I find hard to break.

Well, your experience and career knowledge definitely change how things could be handled. With the clout your certification carries, you're far more likely to be taken seriously with the labor board. In that case, I suppose it boils down to how badly you want to get back at your former employers, lmao. I'm still not sure what exactly they could do about it beyond a possible fine (unless you filed a lawsuit), since they've paid you. Might be worth checking into, though ... even if you don't pursue it, it'd be worth knowing.

Video Lottery and Liquor Licenses have a whole bunch of stupid clauses to them. That would be the only thing I can think of. I just want the company to be on their toes and if anyone else has had this done to them, I'd like them to get their money they are owed.

I think I will end up just emailing the Department of Labor, BBB and a few other places to let them know. Just so there's a paper file of it somewhere just to ease myself haha.
