Whole story:


FRIDAY:

My fiance started her own company 3 weeks ago. Last week she received a mail - inside was something looking like an official letter from government, with official stamps etc - calling her to pay 195 PLN (46EUR) for mandatory registration in "Polish Companies Registry. Below was a blanket to send money via bank transfer. On the other side of sheet of paper there was written with small letters that "This is just an advertisement. No payment is mandatory. We are not government agency, but just private company".


WEDNESDAY:

We went with that letter to police to report a fraud attempt. 1st policeman told us it's not a fraud, because there's this text on the other side. We said we'd like to report anyway and let a court decide if it's a fraud or not. He told us we'll have to wait for his supervisor.

His supervisor comes, we tell whole story over again - he says he cannot take our statement cause it's no Police work and we should go to civil court if we want to. I take out my smartphone and google through polish law codexes and show him a point that it's not a matyter for civil court but for the police. Very unhappy he writes down a statement then he asks me for a smartphone I just googled it on. I think he wants to copy what paragraph number it is or something, but no - he puts a smartphone into an evidence bag. WTF? - I ask. "You used your company's smartphone for private matters, which is against the law.". "It's not company's smartphone! It's my private phone. Plus I bought it over 1.5 year ago while company is up for just 1.5 week!". "In this case we will have to verify it - if it's really private smartphone, not a company one. You can take it back in 24 hours". "Can I at least have my SIM card back?". "No, SIM card is part of protected evidence now". He gives me piece of paper to come back tommorow for my phone.


THURSDAY :

I go to pick up my phone. They give it back to me - batterry dead. I go back t home, charge it - and what do I see? 26 calls made while phone was there, whole internet package used, shitload of some useless shitty apps from "money-for-download" pages installed. I go back to police to report it. What do I hear? "You probably made all these calls and downloaded all this stuff right now, while changing phone clock, just to blame police". For next few minutes I try to calmly resolve this issue - but I hear that if I don't stop talking I'm the one who they will arrest for fraud on them - as I obviously try to scam them for compensation right now. The moment I hear it I break - I scream on an idiot who tells me this that he must be a moron, that the fucking Android would change all timers the moment I'd change time, and that some fucking asshole from their fucking police station is just a thief that decided to use smartphone which was suposed to be evidence to save himself some money and earn some fucking credits on some shitty website for downloading shitty aps.

Next thing I know I lie on the ground handcuffed behind my back. They take me to prosecutors and I find out I'm charged with insulting police officer (because I used vulgar language) and resisting an arrest (yeah - me fat, unhealthy nerd resisted 3 bigass muscled cops who were lying on me and handcuffing me). And I hear I now face a threat of big fine or up to one year of jail time... So yeah - that's my story - if you read up to here the GA cove is hidden right after Thursday.


AFTER NECRO EDIT

OK... idk why the hell someone necroed such an old topic, you're an idiot dear sir, but as for update how things ended up:

  1. Prosecution refused to drop charges and insisted about getting case into court.
  2. Then to make the whole process longer they insisted on psychiatric evaluation - deciding it one month after the case started o.O then waiting 2 weeks for a visit to a doctor so the doctor after 15 minutes can tell that no, I'm not a psycho.
  3. In the meantime of all this bullshit going on the year ended.
  4. Right at the start of the new year prosecution suddenly drops charges because of "low level of harm towards society".
  5. Seems that it got so long, because t was easy case to booost statistics. Apparently they results are evaluated not solely on number of cases they solve, but rather on number of cases and how long they work on them. They had no case, but they were running a case anyway, so in stats they were working hard for society.
  6. I did not file a civil case, because the expenses I'd have to pay were just silly compared to almost nothing I could get. Return of my 2 days salary because that's how many days I couldn't work.

fakt, że używali twojego smartfona jest do udowodnienia, pisałbym od razu do rzecznika plus jakiś blog lub prasa i mundurowi mają przechlapane. Będziesz musiał się prawdopodobnie z telefonem pożegna na parę lat bo bedzie dowodem rzeczowym :/ Z drugiej strony lepiej by było gdybyś po prostu złożył skarge lub ich pozwał, a nie kłócił się bo za obrazę, przekleństwa itp, coś Ci tam mogą zrobić niby.

ważne jest czy w komisariacie był monitoring z fonią. Często już podobne rzeczy są. Jeżeli tak i dowód "nie zginie" a nie przegiąłeś za bardzo, nie powinni Ci wiele zrobić.

Jednak jeśli to było uzasadnione, to raczej powinno to być chociaż złagodzone. Przecież każdy po czymś takim byłby zdenerwowany i by mu nerwy puściły. To raczej też trza wziąć pod uwagę. Inaczej się patrzy gdy jakiś nastolatek ryczy JP i obraża policje, a inaczej, gdy ci wykręcają taki numer. Przynajmniej ja tak uważam.

W ogóle. teoretycznie, ale podkreślam to TEORETYCZNIE istnieje wolność słowa. Szkoda tylko, że w praktyce to nie istnieje.

A tak pół żartem pół serio. Idź z tym do telewizji (uwaga) ciekawe co by ci odpowiedzieli.

nie było, pisałem już o tym w topicu - mały komisariat na małe osiedle na obrzezqach wrocławia - nawet kompa tam żadnego nie mieli (powiedziałem im, że mogą sprawdzić ta "firmę" i że cała masa zgłoszeń na necie, a oni, że nie mogą, bo komputera nie ma).

A co np z bilingami za połączenia telefoniczne? Powinieneś mieć tam dokładne daty i czasy połączeń telefonicznych, a jeśli telefon był dowodem rzeczowym, to chyba powinni to mieć gdzieś spisane w dokumentacji?

Nie znam się zbytnio na prawie, na działaniu sądownictwa też nie. Jednak wydaje mi się, że jakbyś im to udowodnił, mogłoby to być okolicznością łagodzącą?
Bo to, że złamałeś jakieś tam prawo nie ulega wątpliwości. Za to samo chyba niektórych po marszu niepodległości chcą ukarać. Tylko, że oni złamali chyba więcej przepisów, poczynając od zaniechania wszczęcia postępowania, po sprawę z telefonem.

niestety wychodzi ze nie znasz sie (wnioskujac z mojej rozmowy z prawnikiem - ja sam tez sie nie znam ;p ). Jakichkolwiek nie mialbym podstaw nie wplywa to na to ze zwysywalem tego policjanta ani na "opór przy aresztowaniu", którego z braku kamer nie mogę unieważnić. Moją główną szansą atm jest niska szkodliwość społeczna i umorzenie. Niesmak pozostanie - bo niby wychodzi, że coś zrobiłem ale nieszkodliwie - ale dla mnie to obecnie najlepsza opcja, a sry ale "umierać" za uczciwość nie zamierzam.

I've NEVER had a good interaction with any police before, I've been harassed since I was a young teenager and I'm not even a thug, I don't dress like a thug etc.

If you ever need a place to hide out at if you decide to leave the country, you can come stay with me!

It's a small place, but it's better than a jail cell!

Hope everything works out and you at least get a decent lawyer and a decent judge.

Sadly, I know what it's like to deal with corrupt road pirates(cops), who think that because they wear a piece of metal on their chest, they don't have to obey the laws that everyone else does.

It's something that I wish no one had to ever deal with, but it happens.

In many countries, like Poland, it's a lot worse than the US because of the insanely strict laws and very limited free speech issue, which is really sad and it pisses me off to no end! >_<

the sad thing is that even if I prove they missused my phone it doesn't mean I didn't insult them. And case is for me insulting them and resisting arrest so the thing if I was right or wrong does not matter for these things.

You sue them as well - For the unlawful use of your property, for mistreating evidence, for spending your minutes and data plan, for damaging your financial situation, for trying to avoid their police duties when you came to report the case in the fist place,... find a good lawyer he'll come up with a few more. :) Also, find a lawyer who is well known to protect the civilians from police torture and abuse, find some civil/human rights lawyer. Also, contact human rights organization in your country, google it and tell them what you've told us. AND the MOST IMPORTANT take this to the MEDIA! Government and the police don't like bad media coverage... Send this same story you wrote here to a couple of media companies and respectable journalists, they'll be interested, be sure of that. ;)
Don't just give up and wait for the verdict. Fight for this as you fought it at the beginning!

I hate to break it for you, but in this country, spare for media - this could have immediate impact, but the media can ignore you or make you look even worse, I have worse experience with them than police - this may be no-win situation.
Judges can believe officers testimony without doubt, while dismissing solid proof and experts against them. When I witnessed in court some years ago, judge dictated the protocol (I've heard they're recorded now), so she changed my words in a way that made me discredit myself and effect condemn the side my testimony was defending.
Strange thing is, I know a few cops and I work with some other on professional ground, and they're really nice and honest people. But when you face them as organization, anonymously, the police is often terrible. When I face anonymous cop professionally, I give them the same stance they give me - I'm not a person, I'm institution representative and they have no choice but to treat me so (or else my boss calls their boss). But privately, I rather avoid contact with them as much as possible.

Well in any country the media is more or less the same and can make you look bad, but some of the media is under the gov control, some is against government in power / for other political option, and there is some free and independent media - so there may be interest for the story in order to damage gov reputation / current political option in power. Or they might be just interested in defending civil rights as I said above. And the OP should use that in his favor.

As for the police, he made a couple of mistakes, and he shouldn't have f*ck with the police and go all ACAB on them, in the precinct... but I won't get into that because "shoulda woulda coulda" won't help him. :)

As for the media, yes, but I've seen some first hand examples of how media exploit such people. I would turn to them only in I had to. It's a two-edged sword. And yes, being aggresive towards an officer is foolish.
Especially in country where police can beat the hell out of member of Parliament out in the street for such behaviour :P

Yeah, the media often wants blood, doesn't matter what's the truth as long as the one who seems violent gets the beating and jail time - and as long as viewers/readers get their daily dosage of anger. :D

You should sue all those idiots. Police abuse is strong these days in Poland if you follow the news. I was always saying good stuff about police and defending them, saying they're necessary and so on but these days all I see from them is power abuse and thinking they can do anything. Not doing what they're supposed to do but doing something completely opposite. Stupidity, fuckery and shit. That's how law in Poland works - you want to enforce justice on people who are truly frauds and thieves and you end up being a criminal for doing so. That's a perfect summary for this fucking joke called "justice" which is served in our country.

Od razu na polski - polecam rozwinąć sprawę na forumprawne.org lub e-prawnik.pl - dość szybko można uzyskać odpowiedź. O popełnieniu przestępstwa przez funkcjonariusza publicznego mówi art. 231 kodeksu karnego. Jeśli zaś chodzi o o sam list to powinniście to zgłosić do UOKiK-u. Próba oszustwa, wprowadzenie potencjalnego konsumenta w błąd - pewnie dużo firm dostało podobne pismo.

All of the polish public services kinda suck.. Today i was in the hospital to control my lungs (had an operation month ago). Guess what - the rtg machine broked. Doc said "Oh - not big deal, you need to sing up for December" Poland healthcare stronk.

Is Poland health care still about $? Back in the 90s, if you didn't pay out of your pocket they wouldn't do much.

Recently my mom was on the phone with her friend and she said that her mother had something wrong with her, not sure what but her fingers were black or something. Long story short, doctors said she was fine and she died a few days later.

Basically theres a lot less corruption in health-care system nowadays, but system itself is shitty and broken - you have to wait months (sometimes over a year) to visit a specialist or have even a minor operation. So basically even if there's no corruption you're still going to pay them anyway - because if you don't want to wait half a year for a visit you will go privately to private health centre and pay there anyway.

Try contacting the press or some dudes on tv with a show on dealing with scams and other kinds of abuse and tell them what happened. They usually back the fuck off when journalists and reporters start asking questions about such stuff.
