pretty sure i saw somewhere that action is taken only for 3 month old giveaways at most.
seems reasonable since if you get temporary suspension, you can get reported over and over...

I can confirm that is not the case, at least not 3 montsh. Recently I got suspended for 2 giveaways I won 5 months ago, where the first one I had just forgotten to activate (so it was indeed a fair suspension and the fault was on my side) and the second one had the creator accidentally sent it to someone else, so he gave me 2 other games and we called it a deal.

Well, I activated the key that I had forgotten to activate, and about the second one I couldn't be bothered to report the "error" as I had just 2 days left of the suspension when I noticed it, so I figured it'd be gone before they'd be able to review my report anyway. Hopefully I won't have any problems with the suspensions in the future, but if I do I guess I'll file a report about it.

usually when that happens the winner accept the first one and refuses the second explaining what happened to the giveaway creator, easy as that

A Game of Dwarves seems to have some issues, not sure if it shows on library, but I know steamgifts sometimes won't synch it. A while back I remember trying to enter for DLC for the game but in the giveaway page I would get the message that I didn't own the main game.

A Game of Dwarves does not appear in libraries due to a Steam bug, unless you've played it in the last 2 weeks. Don't worry, we have a list of games like this to avoid mistaken suspensions.

The best way is to find someone with suitable verison and who is in need of yours.

According to the rules, all wins must be activated on the winner's account so if you receive a different game than the one that was stated in the giveaway, or if you can't activate the gift due to regional restriction and you mark it as "received" you risk a suspension.
So you have to mark it as "not received".
You also should return it to the previous owner. He could request the deletion of the giveaway, but he needs your agreement.
Please don't trade it or regift it.

Happened to me once, accepted the gift blindly without realising it was region locked, communicate and send the gift back to the creator. He told me to mark it as received and did it out of goodwill since he did send the gift to me but did not know it was not the right way. Received a 5 day suspension trying to be a good guy. Learn my mistake and read all the rules thoroughly now.

As others suggested, you need to contact the creator of the giveaway to resolve this. If you acquire one that you can activate, you can mark it as Received. If not, you should mark it as Not Received.

The game was Metro Last Light. The creator did say he wasn't about the region status.
