Not really the same. With family sharing you are still the owner of the game. Ignoring the need for background checks/licenses for simplicity if I sell you a gun what you do with it is neither my concern or my responsibility. If however I lend you my gun I am going to be complicit in some way, shape or form for what you do with it.

I'm not saying it makes any sense in this situation but there is a basis for it.
