As long as the Steam client supports XP and Vista (although their combined userbase on Steam is less than 3%) I don't see a reason why they shouldn't allow it to be sold, but it would probably be wise to put a warning like they do for Fallout 3 near the buy button.
Running an XP/Vista virtual machine with 3D acceleration is also an option if dual-booting won't work due to lack of drivers, though that tends to be hit and miss. It looks like the game might work with WINE too on Mac/Linux.

So I played this game on Wii and loved it. I've been thinking about getting it on Steam for some time but now I see that the game has major crashes with windows 10, people say it won't be patched because it's too old. http://steamcommunity.com/app/12200/discussions/
Shouldn't it be removed from the store if not patched ? Will it be ?
Maybe it's time for me to buy a copy I won't be able to play since I've updated to W10.
