Just a heads up for people making giveaways to be careful when selecting Z: Escape to pick the one with the space and colon between Z and Escape.

There's another game called ZEscape which is named similarly enough to maybe cause some problems.

Just had George's Memories revoked. Was given it by a friend so not sure where he got the key. Two last times it was in a bundle was this one (Go Go Limited #79) and Indiegala's Monday Motivation #56.
So will not point fingers (just going to look funny at Go Go for a while).

bought 3 keys (to share) of George's Memories Ep.1, at DIG.
purchase was made on 2018-10-02.

can't be 100% sure, but i'd still say keys weren't there (at DIG) since August (IG bundle), cause i usually buy "new" keys as soon as they show up on DIG.

seeing that we're back at these sucka-seller-adventures... i've tried to redeem a key and it works.
kinda glad, cause this could means DIG pays developers/publishers/etceteras...

so, i still have two 1 key. if you've created a giveaway and winner got his key revoked, shoot a comment below so i can send it to you

On the positive side, I only gave away one key of this game from this bundle. And on even-more-positive side, I had an extra key from Indiegala to replace it.

On the negative side I have 11 more useless keys of this game left over now.

Comment has been collapsed.

On the even-more-negative side gogotaku is ancient history by now and key replacement from dev is going to be unlikely in most of these cases. Especially as they realize the gravity of the situation.

Dev will likely never get paid from gogotaku, and revocation of already activated keys sold to innocent customers seems rather heavy-handed and punitive. But it's within their rights.

If I unknowingly buy stolen property from a thief, I don't get to keep the stolen item. Police will make me return it to its rightful owner. I will lose my money paid (I can try to recover it in court by suing the person who sold it to me illegally.) At least in the USA.

However, Steam keys are not even "property" in that sense, they are digital subscription licenses and may be revoked at any time for any reason. Every time we activate a key we accept the agreement without reading it..., which says something like "subscriptions are valid until they are terminated" and Valve can terminate it at any time for any reason. In this case the reason is that the dev/publisher requested it.

I realize 99% of these devs dealing with gogotaku are probably not professionals and do not have an accounts receivable department or a lawyer on retainer. They probably don't know the procedure or have the resources to file a claim as a creditor in liquidation proceedings of a French court anyway.

In my eyes the real anger of the customers should be with gogotaku, they were the facilitators. Whether Bacq Stellan or Chris Hede or whoever was running gogotaku in the final months was knowingly and fraudulently engaging in contracts with devs with the intention of taking the profits and going into liquidation, we may never know. But on the surface it sure looks awfully suspicious to me.

Did I buy games that got revoked? Yes. Does that disappoint and inconvenience me? Yes. Am I going into a rage about it? Nah.

I feel sorry for the devs who got scammed. I wouldn't revoke already-used keys if I were in their position, but I understand why they do it.

Buying trash games for pennies from shady sites moving keys at bulk discounts carries a certain risk. As the old saying goes "if you lie down with dogs, you get up with fleas."

I've probably had dozens of keys revoked over the years and the Earth is still spinning. Life goes on. And that's the positive side of the negative side. :)

maybe i'll keep on thinking about this in a couple of days, so, this is just a.. placeholder, a personal reminder, and while we are here:
the more this happens the more it kinda shows a pattern. i'm thinking about "timing", mostly. also why IG ones are good.
guessing... all this has been done truly better than initially thought.

You should contact the giveaway hoster first and either he provides you with a new key, or he asks support to delete the gib (with your permission).

I don’t know the laws in your country. But in Denmark it’s also against the law, and guess it’s the same in many other countries.

You cannot sell a product on credit, and just drive out taking it back from hundreds of private persons, when you don’t get your money from the company you sold it to. The credit you give the company is at YOUR risk, and does not concern the end user.

it would depend on where you're situated and what type of consumer laws they have.. So some areas revoking a key someone paid for could be considered unlawful.. Pretty sure in the EU they can't technically remove a purchased key

Although nobody is going to care about a few hundred cases of a product that probably barely total'd over a hundred bucks..

In all honesty most of these developers are better off explaining the situation to their players and releasing a piece of DLC content to recoup the money.. I know many people would be on board with helping out in that way, rather than feeling like they got ripped off..

Permalink

Comment has been collapsed.

but you can't get ownership of something stolen... so if you buy something, that the guy you bought from did not pay for, you will have to give it back. Sooo yes the ppl producing the bed can force you to give it back, or pay for it.

  • edit * and yes this is the way in germany, so i guess also in whole of europe. Ofc, if this is the case you are allowed to also get your money back if the seller does not provide a new key(they will even have to buy one from the store if they have none laying around).

  • edit 2* also stlpaul descripted the whole thing a little longer ( https://www.steamgifts.com/discussion/H6HGk/gogobundle-go-go-bundle-limited-79-apr-02-dojini-revoked#puJJVby ) für the us. for the eu, the only change to that is that eula parts that are surprising are not legal. I would count "subscriptions are valid until they are terminated" as surprising.

It wasn't stole. The dev willingly authorized the reseller to distribute it. If the dev has not been paid (not proven), then it is a contract dispute. The only wrinkle here is that you don't actually buy or own a game. It is liscenced for use.

Yes, actually had a chat with that dev last week, about some broken achievements, he seemed nice enough willing to fix it, to feel this might been an accident and he will give a solution, also he would have revoked other games of his.

I am sorry "

My reply:
"What?

I didnt bought a group. What i did was a groupbuy for this bundle, if you cant send me the 150 keys tell me , and i will contact all the users of the groupbuy to contact you thenselfs to ask for a new key

What i did was not a profit nor to be resold later, was just a groupbuy to get the best price to all the users that participate in the groupbuy"

Just got revoked from my account. I had traded for it 8 months ago. Developer revoked all keys sold/consigned to GoGoBundle for non-payment. Wouldn't be surprised if keys from other sites are revoked because they sourced them from GoGoBundle.

Go Go Bundle Limited #79 https://barter.vg/bundle/3731/

Looks like it was a bulk buy bundle.

Developer claims (copied in case dev edits or deletes):
IF YOU GOT YOUR CODE REVOKED
Dear users,

If you got your code revoked, it was bought at GoGoBundle. The owner of this website didn't pay my share of the sales, and as part of the agreement, the keys were revoked. Also, the owner now owns a website of cheat bundles.

Cheers,
Lospi

You are totally right, since the developer just made it between us and the bundle site by revoking the keys.

But the developer just admitted to fraud in the thread posted on Steam. That's why I reported the developer and the game.

If what you were selling were a physical thing, you wouldn't go out to all the customers and take back your product... It's illegal even if it's a digital product.

If you buy a stolen car you don't get to keep it either. I don't see why it should be any different for digital product.

And you have lot of ways to solve issue, contact the seller, contact the payment provider, take them to court. Simple.

No you are wrong. Why should developer be one to suffer? And the scammers profit?
The buyer by keeping the fraudulently acquired product and the seller the money?

Isn't it justice that the product gets disabled. The buyers reclaim the money from sellers. And the seller doesn't get to keep his criminal gains. If the developer is lucky they might even get some money as people rebuy the product from legitimate source...

Look for laws in your country regarding owning stolen gods. Everywhere you're not "owner" of something when you bought it from thief. Even if you paid for it. Police will simply confiscate goods you bought and you're not given any refund. You'd need to go for money to thief. Not original owner.

If developer made deal with HumbleBundle to get 1$ for every sold bundle with their game and didn't get a penny - they have every right to revoke all keys they gave to HB. And customers need to contact with HB, not developer, as it's bundle site at fault.

https://www.citizensadvice.org.uk/scotland/consumer/somethings-gone-wrong-with-a-purchase/stolen-goods-s1/

If you buy stolen goods, the general rule is that you are not the legal owner even if you paid a fair price and didn’t know that the goods were stolen. The person who originally owned them is still the legal owner.
.
If you discover you’ve bought stolen goods you should stop using them immediately.
.
If you know who the legal owner of the goods is you should inform them that you have their goods and let them take them away. If you don’t give them back and the owner finds out you have them, the owner can apply for a court order to make you return the goods.

Permalink

Comment has been collapsed.

In the first part you are talking about stolen gods. In the second part you are talking about breach of contract, which is two totally different things.

In this case the developer sold games to GoGoBundle on credit. Then GoGoBundle went bankrupt, and the developer didn't get his money. This is the risk you are taking when selling things with credit. If you are not willing to risk losing your money, then you have to get the money upfront.

Developer got his wares stolen. He did only right thing and disabled those wares, just like other stolen property with remove wipe. Customer complains instead dealing with shop who is his direct contact.

Really the entitlement in this age... People really want the original owner to give their stolen phone or car to them for free if they purchased it from the thief...

It was such shady site - why did people buy from them? Their fault, now take the responsibility and deal with it.

For all we know the contract might have included provision for revoking keys, which the site failed to inform it customers. Still issue between customers and site not in anyway involving the poor developer.

You might have paid for it but the party you got the game did not. Thus fraud. Thus the chain moves to both directions. You deal with the seller and dev deals with seller by disabling the fraudulently acquired products. Easy and simple.

Why should you get away scot-free from buying fraudulently acquired product? I think it's entirely reasonable for you to deal with the party you originally dealt with.

People really want the original owner to give their stolen phone or car to them for free if they purchased it from the thief...

I would like to:

  1. The original owner giving proof that it's their phone or car and that it was indeed stolen. Preferably by going to the police in order for them to catch the thief.
  2. Deal with the police (in this case, Valve/Steam), not the original owner.

I don't see myself waking in the middle of the night with someone standing right next to me and saying "oh, don't worry, I just came to get my stolen phone back, you can go back to sleep now".

There's a lot to discuss about Valve/steam's responsibility in all this, too.
