IMO that person should be banned from the site.. if they do a contest and dont hand out the game they should be kicked forever!!!

I say a two strikes policy - first offence they get a warning, second offence they are banned. Sometimes people make mistakes, and once a giveaway is live, there is no way to delete it.

I also think that either way all points should be refunded.

There is also the case, however, where maybe the winner of the contest is seen to already have owned the game. In that case the gifter might want to just redo the contest, or send it to another random winner.

In that case he could receive negative feedback and the banning wouldn't seem justified.

It should be a requirement that gifter must explain to the mod why he/she decided not to gift the game (There should be a form for the gifter to fill out). If it's justifiable, like the example you gave, gifter has the right to choose another random winner or make a new giveaway without penalty.

I don't think the contest should be re-done, but I do think another winner could be picked... This way no points would need to be refunded anyway.

I will not make good on my giveaways if the winner already owns the exact same game I'm giving away on Steam

I am having the opposite problem. I did a giveaway, sent the game, and the person hasn't opened it, or tried contacting me. There should be a limit on time for people to get the games too, just like the gifter has 1 week to send it. They should have 1 week to redeem it.

Well CG has made both myself and Cult moderators of the site. We currently do not possess many powers (for want of a better term) on the site, but I suspect part of our future duties would be resolving cases such as what you just listed.

i think a 2 strike policy is a little harsh i think it should be this. 1 warning half of your points be taken off you 2 all of your points be taken off you and you cant gain any points for 1 month 3 and your out?
