Humble Bundle and Indie Gala prevent selling and/or gifting of bundles separately, since they also offer DRM-free versions.

So why cant they just make it so you need it in your inventory to make a giveaway for non key games?

Because there's no way of forcing that to occur -- SteamGifts has no control over the actual transaction. Besides, you could buy a copy of, say, Amnesia on Steam... and then keep creating giveaways for the bundle copies. You've got a copy in your inventory for all to see and screenshot, but it doesn't actually get used. Meanwhile, as far as the site goes, and unless someone decides to report you for giving them a key when you said it was an inventory item (and the number of people happily entering rule-breaking giveaways, like 3-day gift passes or what are outright stated to be bundle keys by the gifter, means this won't happen often), you can keep going and it appears to be legit.

They can if they do what Steam Exchange (from what I can tell this all done with steam) When making a trade, Cant list games you dont have in inventory.
(there would be alot less people who do it and banning would be more manageable)

okay, will try to make it simple. (did you even go to the site...just checking?)
Do what I said above, but make another section for key or list keys ver. with the others. Since they dont have the game in the inventory, they cant not make a non key giveaway, only key ver. of the giveaway.

sigh...they would have to have it in the inventory. Its not asking, it searches the person inventory for games. So if no games show up, you cant make a giveaway. Now lets say they do have games in the inventory, it would list all the games in the inventory they have. They would click on a game they want to make a qiveaway with.(for non key games)

Read what I said BEFORE you linked that site, because obviously you didn't.
To say it again: Someone can buy a game, say, Amnesia, in Steam. Now they have an inventory item.
Now they create a giveaway for Amnesia. It checks their inventory, allows them to proceed. Then they give the winner a bundle key. Now they create another giveaway for another copy of Amnesia, since they have more bundle keys. The system checks their inventory, allows them to proceed since there is still a copy of Amnesia in the inventory.

Yes, they could, but having to buy something would drastically lower the people exploiting the site.
Not saying it 100% exploit proof, but it a hell a lot better then letting them walk all over the mods.
Anyways thought of a even worse case, I did not put steam trade in to play, nice talk anyways.

People can lie, but the more burdens you put on people to tell the truth, the less likely they are to lie.
On the other hand, though, that also gradually reduces the number of legit giveaways.
