It's just fake preorder. It happens. From another hand, date 2021-12-31 is kinda real, basing on this tweet (this user leaked many details from Take-Two) which said at 2020-04-16 game was "halfway done"

Not very knowledgeable, but isn't this illegal to do? I imagine the money spent on such a thing would just end up in a void and you'd get nothing in return due to hidden contract clauses or something like that.

Depends on the region you are living in. It is obviously harder for customs service to find it and "stop it". With physical goods, it's a way easier
since "customs have the right to seize and destroy fake goods bought from outside Europe.".

The "vendor" in this case is Kinguin itself. G2Pay is them, it is just a secondary shell company under the same address. Its website even admits that it is a Kinguin subsidiary. So, they would pay the penalty fee to themselves.
