Why would they get banned? As far as I know, Humble Bundles are still allowed to be gifted, and since its a separate key, its allowed to be gifted separately. The game itself will be added to the bundled listed and everything will continue as normal.

Where did you get the information that it's restricted to Germany?

There was just an issue with keys to German customers who purchased the bundle prior to 23:00 CET on November 29th, they just need to email humble bundle support and they'll receive their German version key, but it's not restricted.

Edit: When you win a key here you don't get a German key. Those people haven't bought the bundle and Humble Bundle won't give them German keys (they don't even want you to share the keys).

It's against Humble Bundle TOS to give away part of the bundle. All keys are for personal use. If you want to give away the games, you should buy a separate gift copy of the bundle to give out. SteamGifts does still respect those TOS, so you can(should) get in trouble for gifting part of a humble bundle regardless of whether it's region restricted. That's just the cherry on top of this situation.

It's marked as a bundle game so that people can't give away the whole bundle and get full credit for it. That doesn't mean it's okay to give away part of the bundle. Just that if you break the rules and DO, you'll not get rewarded.

SR3 is provided as a separate key in addition to the bundle, not as part of it. Whilst they ask that you not separate games from the bundle you can't do that anyway. There shouldn't really be an issue with passing on SR3 keys.

They don't have the means to fully enforce it as the problem was becoming too big. So they just changed the policy a few months ago and bundle games can only give you so much contributor status now. They still ask people not to break TOS but won't be the ones enforcing it.

Actually, SG not-officially supports breaking the TOS. Whole reason why Bundle lists was created was making contributor status, which caused lots of Bundle-Games to appear, even through few of those had "keys are for buyer use only" point in TOS.
At first, all bundle giveaways were deleted. But after "over 9000" giveaway was deleted, cg decided to screw this, put $30 limit on bundle games and don't care about some giveaways breaking TOS, because it's giveaway-maker problem whether that giveaway breakes TOS or not.

Question. Why Saints Row 3 is considered bundle game (since gifter would have to pay those $4 to get it, so it's like -90% sale), while games like Rome (with its $1) aren't?
Or there's some different reason here, like "it's not really permitted by bundle-owner, but tons of people would give them away anyway, so at least there's going to be a little punishment for that"?

Because with the Indie Bundles you can set your own price - I believe that is the reason anyway.

With steam/amazon/publisher/develop bundles, you have to pay whatever price is set rather than whatever you want.

Because you get $6 real contribution value for giving away the whole bundle (the right way to do it). You get bundle credit for giving away just SR because it's worth much less than $40 now.

You want your 6 bucks give away the bundle or buy a $1 below average bundle to give away with SR.

I agree that if the site wanted to split out SR for $5 and do a "THQ Bundle (SR Only)", that would work (or if they just wanted to have the regular SR 3 be worth $5 like Darkkrows suggests). But they haven't chosen to go down that route.

If Humble Bundle adds a game to the above average, then argument that SR is worth $5 is no longer valid.

I think the site doesn't want to encourage breaking up bundles (this is a guess). It's either the whole below average version, or the whole above average version if you want real contribution value. My guess is that this is a much easier policy to implement too - it's somewhat rare that the BTA value corresponds directly to 1 game key.

I think any argument that SR3 should be worth $5 real value would be stronger after the bundle is over and it's known that it is the only thing you get for $5. But again, I'm not sure the site will go for that argument.

You will get Bundle contribution value which in your case since you've already maxed out your bundle contributions ($25 + MIN(.02 * real contribution value, bundle value), means your contribution value would not increase until you gave away non-bundle content. To get the full $39.99 for SR3 you would need to give away $200 worth of non-bundle games.

This bundle thing is bad in one way actually. I got Bit. Trip. Runner Steam gift (gift not key) and it was bought. I gave it away and I didn't get shit. Why? Because I had given away bundle games before because I didn't need them. I want my fucking contributor value for Bit. Trip. Runner god damn it! I don't give a fuck about what I get from indie bundles and what I don't get for them but atleast give full amount of money for games that are giftable! This system sucks balls...

You should just giveaway games for the sake of giving rather than for the contributor... The bundle list is to stop people from buying loads of games for $1 for a few and giving them away for contribution points of ~$10 per game. It doesn't suck.

If you were that bothered about the contribution value, why didn't you find a game that wasn't on the bundle list and then trade your Bit Trip Runner for a copy of the other game and gifted that?!
