If the GA creator fails to provide you a copy you can use don't do anything with the key and mark the GA not received.

Don't mark it as received and you have not broken any rules so nothing will happen to you, the game will not show on your account here to anyone other than support. The giveaway creator will not get credit for the giveaway.
Do not give the key away to someone else because that is against the rules.
You can leave it unmarked and be done with it, if the giveaway creator wants to get credit, he/she can ask for a reroll since you already gave permission.
If you really want to get the giveaway off your account and into the hands of someone who might want to play it, you can mark it as not received after 7 days and this will force the giveaway creator to request a reroll or be stuck with a not received on their account.
You can also give the giveaway creator permission to delete the giveaway if you want. They will need to put in a request for that as well though.

Thanks for the advice AllTracTurbo, was beginning to freak out a lil.
I think I will go with the mark it as not received, I have asked him twice now to re-roll so it can go to someone that can actually use it.
So I think i'll just put the ball back in his court and he can decide what he wants to do after I mark it not received.
There was no way I was ever gonna consider re-gifting it, for him to say that blew me away.
The giveaway being on my account as not received doesn't bother me, I just want the game to go to someone that can use it and wants it.
So hopefully he will just re-roll the giveaway.

Once you have done the above, you have done everything required, have protected yourself from any backlash, and it's all on the giveaway creator. If he/she finally decides to work with you, great. If not, you're free and clear. It is the creator's responsibility to deliver a working copy of the promised game. Anything less than that is considered "not received."

Mark as non received ... thats pretty much all you need to do.
If the GA creator provided you with a key you cannot use you can also report him ( if you want to ) but that may take ages to resolve since the huge amount of reports pending .
So just mark non received , thats all you need to do ... from there on its the GA creator job to deal with the situation .
He can either provide you with a key you can use , or ask for re-roll ( tho it would be better to just delete the GA since its region locked and it will be kinda hard to land on a winner from that region specifically i guess )

So I won a giveaway about 5 days ago for Civ 5, they key was sent through but when I tried to use it I found out that it is region locked for Australia.
So unable to use the code I left a message on the giveaway requesting that the key just be re-rolled and attached a screenshot of the game not being usable by my account.
4 days latter I finally get a reply, and he tells me to re-gift it...
There is no way I'm going to re-gift it, I don't want to get banned for a inactivated win / re-gifting something.
I asked him again to re-roll the giveaway, who knows if it will take him another 4 days to reply.
What should I do?
Is there a ticket with support I can open about this sort of thing?
