I imagine that there are plenty of justified bans (with funny excuses) but some of them are ridiculous and only demonstrate that the mods have an addiction for banning people: for example, some guy got banned for... changing his handle too many times? Is that really justifiable?

It's their service, their rules that you agree to follow the moment you accept the EULA. You break the rules, you suffer the consequences. This is not an example of them not breaking the rules and getting banned anyway. This is an example of them getting banned BECAUSE they broke the rules.

Frankly, I think the mods there need to have a sense of humor if they want to stay sane. Judging by how many people complain (with seemingly no knowledge on how to spell especially, reading some of those hurts my brain), they have to put up with a lot of garbage from a lot of people who broke the rules. Not a fun job.

Alright, I should be more clear. I was referring to the restrictions of changing the colour of my avatar's skin, or something along those lines with your profile info. Not hacking M$'s 360 safeguards and content servers.
I was thinking it'd be like Valve not allowing you to change the colour of your pony's hair and skin in your steam avatar with PS. Like I said, I don't dabble at all with any consoles.

So if i play, say, world of warcraft, I should be able to make my character look like a kurenai, even though he's draenei and kurenai aren't an available player race? Even though there isn't that option in the game and I have to modify game files to get that look?

I have used an exploit. I have modified game files. Such modification can just as easily create an unfair advantage for me. I don't think you're understanding the ramifications of allowing people to use third party software and exploits to abuse the system.
Is cheating OK to? I used the same type of methods I would use for that. How about getting access to someone else's account and impersonating them. Or maybe circumvent the ignore system and spam a person with constant messages?

You are allowed to change your avatar color to any of the colors available. Blue, purple and crap like that are not available. You need to use exploits and tricks to force the system to change the color to one of those.

A person uses third party software or an exploit to change their avatar color to a range that isn't normally allowed by the system. This is also explicitly forbidden in the rules, so the person is breaking the rules directly. This, in your opinion is not a reason for a ban?

A violation of the Code of Conducts earns you a permanent ban - that is out of question. Sure, there is some funny stupidity involved with those avatar-hackers, but I think Microsoft should react by changing something if too many users are too stupid to use their service.

Banned for using an exploit to mod the avatar beyond the implemented parameters. Emphasis on using an exploit. This isn't dumb, this is enforcing to rules to keep the community safer from cheaters and various other third party tool exploiters.

Modding your avatar requires you to
1) Extract your profile off the xbox hard drive using an external program
2) Hex editing the files so that the color you want goes where it's supposed to
3) Reinject and re-sign your profile back onto the hard drive
No part of each step is done 'by accident' and the tools used can equally be used to modify anythign else on the hard drive as well. It's basically like robbing a bank and only getting $1. you still robbed the bank and they don't care how much you managed to get away with.

This is one of my favroties I've seen: http://forums.xbox.com/xbox_forums/xbox_support/f/41/t/201464.aspx Mainly because, if the post is true, that means the account is used by four people, three of which wrote the post. I also love that it falls on the classic "This is my 10 year old son's account that I got him for Christmas because he's an orphan who's mother was killed by being banned" excuse.
Also, I have to say, I'm fairly impressed with how quickly they reply to each of these. I guess it's not surprising given how many there are, but it's still nice to see you don't have to wait a while to find out why like some other services.
