To my point, libel is libel because it is no true. To further that point steam does not advertise their sales, and more conclusively I have never seen steam advertise "we are going to mark down ubi games 90%" if they did state that, and only then NOT mark the item down, then you could draw some parallels.
Market effects from steam sales is purely on the end consumers prognostication. Though I doubt humble bundle potential game "leaks" really have ever hurt a games sales. That would be near impossible to prove, which is the flaw in the OP's statement.

Steam sales, not just Summer/Winter sales, does more "harm" than good to their creators. If I take the Tomb Raider Collection that I bought during the summer sale, at a normal price I would never have bought it, but buying it at 75% off, it's like a steal.
also these Indie bundles do more harm on their own, than speculating on what's going to be in the next one. As why buy a new indie when it comes out, because it's almost a guarantee that in a few months it'll be in a bundle, as an example look at ittle dew & Eandor, both very new games, and you get it in a bundle.

"at a normal price i would have never bought" they're not loosing any money from you if you would have never bought it at that price. I'm sure game publishers/devs would be happy if everyone paid full price for their games, but that's just not possible. Ideally before a game is put into a $1 bundle it would have been put on sale from 25% to 75% to maximize that amount of money ppl spend on their product. I'm sure there's a lot of ppl that would have bought ittle dew and eandor at 66% or 75% if that was available before being put into a $5 bundle.
One of the problems with this is I know devs/pubs don't really have any control over the sale prices of their games on steam. at least that's what i heard. I think they should have more control.

What price? I would think that is obvious: people know you now. You know the saying that any publicity is good publicity? Well that doesn't seem to work here on Steamgifts. You are being your own worst enemy and threads like this aren't helping your image. People will automatically assume that anything coming from you is nonsense. Except that the owners of the games have to agree to their games going into discount bundles like that, so they have to be okay with it. Also, acknowledging the existence of sales, and then speculating the potential for various sales, is not libel.
If I have a discussion online with people about fast food and say "Urgh I bet that new burger that McD is bringing out will be terrible", that's not libel. Neither is "That burger is way too expensive, I bet they'll drop it in price when they realise there isn't much interest".
The common power of observation, the freedom to discuss, and the ability to hold and share an opinion, is not libel. Trying to suggest that waiting for prices to drop to a point you're more willing to purchase at is damaging the commercial industry is a bit silly isn't it?
I mean, you could just say you think the Humble Bundle guessing is a boring/tired subject and you don't like it. That would have saved you a lot of typing and pretence.

Everybody held off buying Dead Space 2 last week because 30€ is a frickin' huge price compared to 1$ for 5 other games... I don't even preorder new games at that price, why would I spend that for an over 2 years old game?

Genius move actually. They update the Steam database to ignite the rumor that Dead Space 2 is in the bundle, then everyone quick jumps on board before the second week so they can get the bonus games but still only pay the minimum. This means more keys distributed and more people installing Origin. The worst case scenario is that a few people hold off on buying Dead Space 2 (at full price anyway) to wait and see what happens. If it's not in the bundle and they still want it after the bundle ends then they buy it. It's a win-win for EA any way you look at it.

I can be a wikipedia-lawyer, too, and point out that due to Dead Space 2 being updated in the Steam database at the same time as the other bundle games, there was reasonable belief that it would be included in the bundle, and people were acting in good faith by speculating in order to save people money rather than hoping to stick it to EA by decreasing sales.

Libelous comments hurt people's reputation and thus make them suffer financially, e.g. if you say that the death rate of surgeries performed by Dr Smith is 80%, you will scare away his patients and Dr Smith will earn less money. That's why libel is a crime in our society, regardless of your countries.
And when we say that next week there will be a Ubisoft Bundle or Lego Bundle, what will happen? Yes, gamers will refrain from purchasing Lego games and games made by Ubi so that they can buy them for $1 later from Humble Bundle. What if they don't show up next week? Just wait, wait and wait, until one day they eventually become Humble.
The results? Ubisoft and Warner Bros will earn less money. So saying a game will feature in Humble Bundle is NOT different from saying that it contains spyware. People will just stay away from it and the developers will suffer financially.
Do a favor to the gaming industry. Stop guessing which games will become Humble.
