Those cosmetics are their own work. Its perfectly legal, they sell their self made stuff.

It doesn't matter if that's their own work, they don't own the Pokemon IP, nor did they ask for Nintendo's approval for the fan-game, and they're making money off it.

Holy crap it's no that difficult to understand. It doesn't matter if they edit some sprites or not because it's about Pokemon. Do they people who made PokeMMO own the Pokemon IP? No? Okay.

The ROMs are used because:

A. It's already pre-made
B. Nintendo has stopped caring about pirated ROMs because they realize it's not something they can controll

You see that's the thing they used the FireRed rom without nintendo's permission and hacked it. So it is real Pokemon

And, actually, no. Nintendo actually hates Piracy and are trying everything they can to stop it. The newer Pokemon/Nintendo games have AP (Anti-Piracy) to prevent people from pirating the games. Not only that but Nintendo and a whole bunch of other game developers have made it illegal to sell a DS flashcart (the thing that lets you play several DS games in one card) in Japan.

Nintendo blocked a homebrew application on the Wii that allowed people to play burnt DVD movies. There was no piracy of Nintendo games involved, simply enabling a feature that had been disabled.

I guess it's just a coincidence that Nintendo keeps releasing firmware updates that block the use of flash carts on the 3DS. It must be a bug, since they clearly don't care about piracy.

it's FireRed with multiplayer so you can play with your friends, it is not a "new" game.
if you want 3D wait for X and Y

There is also Pokemon TCG Online now, it's an official Nintendo F2P card game on PC and MAC.

I would hardly call it F2P as it requires you to purchase TCG packs(or redemption codes) otherwise you're waiting weeks, if not months in order to get new cards.

I thought it was every seven days.

Regardless, you cannot trade those cards and as such, it would take many many weeks of lucky pulls to get close to a real deck.
