Depends on what is owned by the fnaf series. IF they only own the names and titles you can actually remake the model and get away with it. But you do need to make the models and stuff yourself.
Patenting models, or characters, is a bit harder. The character must be very characteristic for the franchise in such a case. Like Spidermand or Ironman would be for Marvel or Batman and the Joker for DC.
The main 4 characters, especially the bear is rather characteristic for the fnaf series. If they patented it that game will be removed sooner or later.

Of course it's going to be removed they are using assets from the Five Nights At Freddys IP. Expect them to get a takedown notice as well as any funds they made returned to the people who buy it and the game revoked.
