Darksiders 2 Van Der Schmash Hammer is not listed in the giveaway list, can i make with another DLC and send this one to the winner?

No. Not unless you're giving away that other DLC too. It can be an added bonus (ie if you're giving away something else, you can throw this in as a freebie), but misleading giveaways of the sort you're talking about can lead to a date with the suspensionhammer...

Nope.

If it's still absent, that's because it's on the "exploited" list, since it was, fairly recently, available for free in practically limitless numbers to anyone who was interested.

Same situation as Penny Arcade 3. May be a while (if ever) before it returns to the giveaways list, and even then it will almost certainly be designated as a bundled game.
