Nothing in life is guaranteed, but many things are highly unlikely. If Amazon took action, it would mean banning thousands upon thousands of accounts, and would create a shitstorm to end all shitstorms. That's just not Amazon's style. Besides, your Borderlinx address is a unique and valid one. I can't see why this would cause an issue.
Many people outside of the US order games using Borderlinx addresses or even the address of Google HQ! That said, I suspect a time may come where distributors put more pressure on Amazon to enforce their regional restrictions more aggressively (ie by IP address checks). Until then, game on ;)

Amazon doesn't need pressure by distributors, unpaid duties and VAT is the main problem here. VAT in Europe is about the 20% of the price.

I understood there was not only a local sales tax which varies from state to state, but also a national sales tax. Not being a US resident, I could be wrong though...
EDIT: Looks as though I am wrong. There ARE federal taxes on certain goods, but most sales are only subject to a single state level sales tax. Perhaps I'm thinking of the Canadian sales tax system?

From my understanding it depends where you live and where the company is located(HQ). if they are the same then you pay the state tax, if not its some loop hole. i think it was in the news a few months back that they wanted to close that loop hole.

I'm speaking about selling from US to non US (Europe). It does not matter whether it's a digital good or not, the tax is always applied. The price should be always: Public price without local tax + tax/duty of the destination country (and that amount should be paid to the foreign state, of course). I don't know about the "Pay what you want" thing, but I have no doubt about the rest.
