Some of the people giving it away actually have it in their library. What is unknown is whether or not they owned it before the keys were given out.

If you ask me...
a) They redeemed the key and created giveaway with dupe key
OR
b) They have multi-account, redeemed legit copy, and now giving away second one.
Of course, there is also case of user buying another copy or receiving key from other source (for example from other regift... or from other site, or from dev), but those cases are really rare. If I was working in support I'd firstly check IPs and make sure that the guy doesn't look suspicious of multi-accounts if he owns the game already. Second thing would be checking if it's not the key he actually received, but I doubt support has enough power to do that.
In general, even if there are valid cases, I can guarantee that at least 99% are fishy. And I can say that at least 99.9% are regifts, some might just not be intentional (such as me winning that game on some other site, and giving it away now. I don't know the source of the key)

If you have an issue with another user, submit a ticket with a user report, rather than calling them out within the community or on the forum.
While it is OK to remind people of the rules, be sure you don't post accusations. (e.g. "You've regifted all the games you won!")

The dev is a self-publisher, and a publisher can generate as many keys for promotional purposes as they want. Even large publishers sometimes hand out tens of thousands of free copies (think like Origin on the House deals). It is just a matter of question that this dev decided to use SteamGifts as a mean to make the promo keys reach the plebspublic.
