If you keep your serial code handy, you can complain to their customer service and very easily get a new one with the software pre-installed. I've done so twice thus far, and I'm pretty certain I'm not the only one. Also, there's a new feature wherein you can backup all your saved games / data onto an SD card :3

Throwing it on the pavement face-down repeatedly should do the trick.
I wasn't referring to flashcarts. Just that there's no account system, and transferring once your 3DS's busted requires sending in the damn hardware to customer service and hope it comes back soon.
Maybe the new backup feature helps, I haven't tested yet since I haven't been playing my 3DS lately.

What's the 3D like on your model? I didn't quite enjoy their vision of "3D", given It was merely viewable from one angle, which sucked.
Game wise, I would suggest any Mario title, I particularly enjoyed 'Super Mario 3D Land', I did like 'Mario Kart 7' but was nothing new really, Zelda is good, if you're into that, I got it, but wasn't my style, too difficult, whether or not you were referring to 3D titles or not, otherwise, I would suggest Pokemon, but I mean, those games are just boring as fck now, nothing truly different in each title.

Avoid the eShop. The prices are terrible (at least, they are here in the UK). It's cheaper to buy retail, if you can.

If you want some cheap stuff from the eShop, get Crimson Shroud! It's a fun RPG with a good story and good replayability. Easily the best eShop purchase I've made so far.
For regular, full-priced games you shouldn't use the eShop, since it's almost always more expensive than buying them retail.

Get the Star Fox game, Pokemon, Mario, Fire Emblem, Legend of Zelda, but buying games for a 3DS I don't think is a good idea, you will spend a lot of money for nothing, just get a cracked card like one guy said before, one familiar I know can play even normal multiplayer and trade things.
