Considering that he has a German user name and the fact that the Sleeping Dogs keys for Germany are non-Definitive, I would assume that it is the original one.

Do we know definitively that the version is based on (the IP address of) who generates the gift link and not who redeems it?

The keys are generated on purchase, based on buyers location (IP address).
