What happens when someone wins a gift and the person refuses to give it to them? I mean, after the gift has been reported as not recieved. What's the punishment to the giver; and does the winner get anything?

Winner gets nothing, sadly. There's too many fake giveaways that get through to the end of their time to cover and who would cover them? Even if the mods or whoever did have infinite money to give to people, that would leave it VASTLY open to abuse.

"Oh, hey, the mods will give you Skyrim if the giveaway person doesn't? I'll make a giveaway on a new Steam account and set up a ton of fake giveaways to enter with my normal account! I'm sure to win at least one of them!"

To answer the question: Sadly, the winner receives nothing, and all you can do is report the offender after the fact. However, you may take comfort in the fact that you are able to help identify and eliminate an undesirable member of the site and prevent him/her from doing the same thing to other people.

It'd be nice to get some points... and the assurance that the jerk was banned, not warned. It seems that the website would be able to check their steam inventory to ensure they have the game in their inventory, before they're even allowed to create the gifting page.

Any fake giveaways that get shut down by the mods give you your points back, even if they're already closed (I believe, anyway). And it's a case-by-case basis. Sometimes there's a genuine reason the user can't give a gift. Maybe they were going to buy it after the giveaway had ended (some do and that's okay), but they got their personal information stolen and their bank account is drained. That's just an extreme example. Sometimes the game turns out to not be available to buy when you plan to (Crysis 2, for instance).

The "not recieved" button isn't an instant ban. The mods look at everything on a case-by-case basis and they're pretty good at banning the people just screwing with the system and going easy on those who just have bad luck.

And the inventory system has been discussed. I believe that would require a) Steam itself to have a system to scan it and b) every user to reveal their inventories publicly. Constantly brought up, constantly shot down as people have a right to privacy. Sorry, OhNoes. May not be what you want to hear, but that's the site policy and I find it very doubtful it will ever change.

I do reckon that somehow the gifter should get something, like when the winner receives the product and has it activated and once they know that it is not fake, then maybe the winner can +1 them and the gifter will get 10 points or something.

It depends. If the winner entered without permission, then it will be rerolled. If you are kicked out of a group and you enter anyhow. Or if you find a leaked private giveaway. Lots of case where denying the winner a game will not get the gifter in trouble.
