There can always be a person that will buy the game just because he won free DLC for it. You can't exclude those people just because they don't have it at the moment..
Ya, whoever wins gets it whether they have Skyrim or not. If the system lets you I don't see why not and it does encourage you to buy the game. I will be away from my PC(hour or so) when this auction ends so don't panic future winner :)
