"Banned" games for giveaways

I'm honestly confused about why the FAQ states that keys from exploited sources are banned, yet you can still gift them. Why not remove them from the list of games you can submit, rather than just getting some people to report the bad giveaways?

You can still buy/gift legit versions

You can still gift those games as long as you give them as a gift, i.e. directly bought from steam.
