Just said in one of the comments on there face book page there are giving refunds to people they bought Bethesda collection and borderlands 2 4 pack rather then keys. O well getting my money back can't really complain about that part.

It's ultimately a business decision. Paying for the full mistake very well could have put them out of business immediately. They've made the choice to cut their losses and I'm sure it wasn't an easy decision. My guess is that the CEO got involved and said "Tell them it will take until Mid-Jan to get keys while we figure out what the fuck we're supposed to do"

Doing this is agianst multiple swedish laws and as i said ealier in the post more people from sweden will file legal action agianst them, what if you had bought one of the packs to give away for Xmas and your son suddenly dosnt have access to them anymore ?. This is gonna cost them a lot more than they feared it would from Bethsda and gearbox´s laywers.

Someone earlier in the thread posted this (auto-translated obviously). My reading indicates that they'll be legally fine as long as they don't revoke keys (since that should count as already being delivered)

well i sent all my copies to a friend, they cant touch them there as that is theft if they do, if you haev the games on your own account they can according to thier TOS but on a friends account where you gifted it all to would be theft which no one is allowed to do.

So legally that should save you in case they start shit, however this is just a try not sure if it will work.

Otherwise i do live in sweden so they can for sure expect a legal action from myself and a few other swedes.

Anyway, the way I see it is this - if there's an offer that looks too good to be true/there are rumblings of a pricing error/website glitch etc. I'll jump on it. But, I'll do so full in the knowledge that whatever goods or services I just purchased run the risk of being cancelled (unsent) with a refund provided. The only time I'd feel unjustly dealt with was if no refund was forthcoming, which it most certainly should be. To claim though, that a website has a duty to actually provide the item in question to a user irregardless of the circumstances is wrong. So long as they haven't taken payment from the user without supplying the goods/service then they've done nothing wrong.

Right, after typing that lot out, via a quick google search I came across this, which a fair few of you need to read!

Yes, EU laws are against a "one-way refund". If you buy something legally, may it be a mistake or not, you have paid for it and it is your right to keep the item and pass over the refund.

Not sure how far back it goes, but you can make a Paypal chargeback on all the items you have purchased from them. I am seriously considering doing this if I don't receive a refund of my $28 by Monday or at the very least some contact to let me know what the hell is going on. After all, it didn't take them any time at all to remove the pack from my account several days ago.

It's as much the principle as anything, but I don't want Gamersgate going to the wall and taking my [admittedly trifling amount of] cash with them.

Fed up of companies acting like this, just because they think they can get away with it...

No I didn't activate my keys :/ But honestly GG is digging themselves a hole for copies they granted keys for.
Why you ask? People (not me, I'm lazy :3) have sold these keys for money. So what will happen?
Original purchaser will receive a refund PLUS middle man payments while the end user (who bought the single key) will either be unaware or pissed as hell when the game disappears.

TL;DR - Retracting copies already with keys is bs; retracting copies without keys doesn't violate laws

I just got mine refunded and I'm not happy. I understand that mistakes happen and refunds may need to be issued and this deal was too good to be intentional, and I wouldn't have been remotely upset if I had gotten a refund within a day or two. But the fact that it took them almost a week, during which time they provided an update that led me to believe I'd be getting the games in January before changing their minds, while a bunch of other good sales elsewhere came and went, annoys me. There were a couple of other games I definitely would have bought (that are no longer on sale) if I didn't think I'd already spent a bunch of money and added a ton of gaming hours to my backlog.

I wasn't able to add a single copy of the bundle to my basket, it only let me add 2 at a time, no idea why. So I went ahead and purchased 2, and when I was told I'd receive keys in January I didn't pick up any other games I was going to buy in sales. I was going to await my keys and then trade the spare bundle for them.

No, I never had any available. I ordered very early in the deal, but by the time I was able to submit payment to complete the pending order they had completely run out of keys and I just had a single, unexpanded entry for the collection in my library.

Here's how you can create and account. First click any game one their site then click "buy" then scroll down and select "create a new account" fill the details and choose paypal proceed to purchase and then you will be redicted to a page that will have the option "send verification email" click it and verify your email. And then you're done. Just add that account to your buddies and the send the gift to it.

What? That's not relevant at all. That means that if you buy something for say £10, the order is confirmed and processed, and then the price increases to say £15, you won't be charged the higher price. You also wouldn't be charged a lower price if the price dropped instead. Absolutely nothing to do with what's being discussed.

Because from what I understand, whole point of that sentence is "change of price won't affect already bought products" - and in this case change of price (to correct one) affects already bought products (since GG decide they don't like old price, so everyone who bought for that price won't receive their goods)..

It's essentially saying that a change of price won't affect the purchase price - a change in the price of the item, either due to a price alteration or a mistake, won't be passed on to the user after they've bought the item, they'll only be charged the price they bought the item at.

It's well know that Gamersgate like to apply a "fast and loose" approach to their own Terms and Conditions (see 15% lifetime IGN discount).

Will be interesting how they fare against EU consumer protection law. I'm pretty sure we don't receive the same protection here, but over in the Eurozone it should make for compelling viewing...
