Most people don't do that. It's actually quite frowned upon to put those fake disclaimers in the description because it's an attempt to preemptively force the winner to agree to delete it if anything goes wrong. Those disclaimers mean nothing.
ANY code could potentially turn out to be a dupe because of non-trustworthy "developers" revoking their games and various other reasons.
Is there any way of not punishing them without being myself the one that is going to be punished?
Yeah, there is and it's quite simple: You comment on the giveaway saying you're fine with deleting it, then the creator can file a ticket with support to get the giveaway removed.

Those disclaimers mean nothing.
I rather view them as an advance notice that "okay it's an old key, or a key from a not-too-reliable site like lootboy, it should work but the probability of it being invalid is a bit higher than with a very fresh key from a top shop".
Not very useful indeed, but communication is always better than lack thereof.

From my vantage point it's all about respect and manners and not intentionally lying to people.
This is an old key... so in the unlikely event it turns out duplicate I would greatly appreciate if you allow me to delete this giveway.
is completely acceptable IMHO but the way most people set up these disclaimers I simply can't view it as anything else than:
I know most people don't have the slightest idea how this site works so I will try to make up my own, unenforceable rules and simply hope you'll comply because you don't know there are other options.

Option 1: Ask if they will replace the key and if they will not honour the giveaway then mark it as Not received.
Option 2: If they do replace the key and it works you can mark it as received.
Option 3: What Sundance85 mentionned above and reply to the giveaway creator and agree to delete the giveaway.
As long as you mark it as received or not received correctly, there will be no punishment to you. Considering, its their first giveaway, i suspect they may not know what to do when this happens. With regards to duplicated keys, it could be for many reasons.

The thing is the the code turns out to be duplicated. I told the giveaway creator and he/she apologized for the inconvenience.
On the one hand the creator didn't even tell the code could be duplicated in the giveaway description.
On the other hand, he/she apologized.
Normally, I think I should mark it as "Not Received", but I think that will punish the creator. Is there any way of not punishing her/him without being myself the one that is going to be punished?
